§4 Participant’s obligations before starting the course and health condition
- A Participant who intends to join the course must not be under the influence of alcohol or other substances, should be physically and mentally healthy, and their psychomotor ability must not be impaired. Joining the classes constitutes a statement that their condition allows participation in activities organized by Snow4Fun and acceptance of responsibility. Persons with health problems should consult a doctor before classes; they may participate only after obtaining a doctor’s consent to practice the high-risk sport. Obtaining this consent is the participant’s responsibility. The participant is not obliged to present a document confirming such consent. Snow4Fun is not liable for injuries/accidents during classes resulting from the participant’s condition or reduced psychomotor ability. The above also applies to parents/guardians of minors.
- It is possible to conduct lessons for persons with disabilities at a reduced level of difficulty. In such a case, it is necessary to inform Snow4Fun in detail about the participant’s health and strictly observe these rules. The presence of the disabled person’s guardian during classes is mandatory. Instructors are not specially trained to work with persons with disabilities. The participant’s ability to take part is assessed by the participant or their guardian, who bears full responsibility. A disabled participant must wear a helmet regardless of age. At the participant’s or guardian’s request, classes may be stopped at any time. The participant and guardian should consult a doctor beforehand and may participate only after obtaining consent to practice the high-risk sport. Obtaining such consent is the responsibility of the participant and guardian. The participant is not obliged to present a document confirming the doctor’s consent.
- The instructor refuses to conduct a lesson if they find a high probability that the participant is under the influence of alcohol (or other intoxicants), or if the participant’s behavior endangers safety — no refund is due in such a case.
- The participant is solely responsible for damage to property, injuries, or harm to themselves or third parties caused while under the influence of alcohol or intoxicants, as well as due to improper use of equipment, incorrect performance of exercises assigned by the Instructor, or failure to observe regulations at the venue (e.g., slope rules).
- The participant must read the regulations of the venue where classes are held, in particular the slope rules and the Winter Playground rules.
- Before starting, the participant must provide the Instructor with detailed and truthful information about skiing/snowboarding skills, health condition, physical and mental fitness, and any ailments that may affect training. Parents/guardians must provide current information about the minor participant’s condition and predispositions for exercises assigned by the Instructor.
- Participation always involves high-risk sport; accidents causing serious injury threatening health and life cannot be entirely excluded. The organizer is not liable for participants’ property or non-property damage arising from participation when the course is conducted in accordance with sports rules related to sports risk.
- Snow4Fun is not responsible for personal or property damage resulting from faulty participant equipment or its improper selection. Instructors do not check participant equipment before classes.
§5 Participant’s obligations during classes
The Participant or legal guardian must:
a. immediately inform the Instructor during classes of any changes to the circumstances indicated in §3 of these rules and of any equipment issues affecting safety;
b. perform only the tasks assigned by the Instructor; the Participant may refuse to perform exercises beforehand. The Instructor is not liable for injury/damage if the Participant fails to perform an exercise according to instructions;
c. immediately report if, for any reason, they wish to change how an exercise is performed, stop it, or end the day’s classes (e.g., fear, dissatisfaction with instruction, or conditions).
§6 Participant safety and procedure in case of an accident
- Participation in classes, training, Skki Trikke and ski tour organized by Snow4Fun, as well as children’s presence at the Winter Playground, always involves high-risk sport. The risk stems from, among others, possible errors by the participant or third parties on the slope/trail, unpredictable forces of nature, sudden weather changes, conditions independent of Snow4Fun, faulty participant equipment and its improper selection (which Snow4Fun does not check and is not responsible for), and other hard-to-predict factors. Accidents causing serious injury threatening health and life cannot be entirely excluded.
- The Participant or legal guardian must immediately inform the instructor if they wish to change how an exercise is performed, stop it, or finish classes that day, including due to fear, dissatisfaction with instruction, or venue conditions (classes, training, ski tour, Skki Trikke, conveyor lift, Winter Playground).
- To ensure maximum safety, the Participant must strictly observe these rules and all instructions and directions given by the Instructor.
- Any Participant who learns of an accident must immediately assist the injured person, in particular by informing the Instructor, calling medical help, and administering first aid if possible.
- In the event of an accident, the Participant must provide a detailed description of the incident, actions taken, and personal data.
- Children under 16 are legally required to wear helmets. The instructor will refuse training if a person under 16 does not have a helmet. Snow4Fun strongly recommends that EVERY participant wear a helmet, as not wearing one may result in serious injury or death. For persons over 16, responsibility for not wearing a helmet lies with the participant or legal guardian.
- The Participant should also follow these rules:– move at a speed that allows safe stopping;– do not cut off other skiers/snowboarders; persons below have right of way;– keep a safe distance when overtaking;– stop in a safe, visible place — at the side of the run;– do not climb or descend the middle of the slope;– pay attention to signs and, if in doubt, ask the Instructor;– do not sit on the slope.
§7 Personal data protection and data administration
- The Participant consents to having their personal data included in the Service Provider’s database and processed to perform the contract. Providing data and consent is voluntary, but lack of data makes it impossible to fulfill the order. The Service Recipient is responsible for providing false personal data.
- Personal data are protected under the Personal Data Protection Act of 29 August 1997 (Journal of Laws 2002 No. 101, item 926, as amended) to prevent third-party access. Service Recipients have the right to access, correct, and request deletion of their personal data.
- The personal data controller is Sport4Fun Katarzyna Kordeusz, ul. Długosza 6/1, 44–100 Gliwice.
§8 Final provisions
- For matters not regulated herein, Polish law applies, in particular the Civil Code and other statutes.
